Lucasarts if it wanted to could lay the major smackdown on any store selling it early. I pre-ordered it at the store 2 weeks ago and like I said am going to pick it up now. I don't know whats going on but I think I lucked out. Or maybe if you pre-ordered you get it a day early :-\.
